Welcome to EMS Shop. These Terms and Conditions (“Terms”) apply to your use of emsshop.ca (the “Site”) and to any purchase you make from us. “EMS Shop”, “we”, “us” and “our” refer to [LEGAL BUSINESS NAME], located at [BUSINESS ADDRESS], Ontario, Canada. “You” and “your” refer to anyone who visits the Site or places an order.

By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Our Products

EMS Shop sells first aid supplies, bleeding control products, CPR masks, oxygen accessories, and new and used CPR/AED training equipment.

  • Training equipment is for training only. CPR manikins, AED trainers and other training devices are not medical devices. They cannot deliver a shock or treat a patient, and must never be used in a real emergency.
  • Emergency products require proper use. Products such as tourniquets, CPR masks and first aid items should be used by people who have received appropriate training. Instructions and guides on the Site are general information only. They do not replace formal first aid training, medical advice or emergency services. In an emergency, call 911.
  • Product information. We try to describe products, specifications and images accurately. Colours, packaging and minor details may vary from photos. If a product is not as described, see our Payment & Refund Policy.

2. Used Equipment

Items marked “Used” have been previously owned. We inspect and test used equipment before listing it, and describe its condition and any known issues on the product page. Used items may show signs of wear, such as marks, scuffs or faded labels, that do not affect how they work. Unless a product page says otherwise, used items do not include a manufacturer’s warranty. Please read the product description carefully before ordering.

3. Accounts

You may need an account to place orders or track them. You are responsible for keeping your login details confidential and for all activity under your account. Tell us right away at info@emsshop.ca if you think your account has been used without permission. We may suspend or close accounts that are used fraudulently or that break these Terms.

4. Prices and Payment

  • All prices are in Canadian dollars (CAD) unless shown otherwise. Applicable taxes (GST/HST/PST) and shipping charges are added at checkout.
  • We accept Visa, Mastercard, American Express, PayPal, Apple Pay, Stripe, Afterpay and, where available, cash on delivery. Afterpay purchases are also subject to Afterpay’s own terms.
  • Prices, promotions and availability can change without notice. Sale prices apply only while the promotion is active and while stock lasts.
  • If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after you have received an order confirmation. We will contact you before cancelling.

5. Orders

Your order is an offer to buy. We accept it when we ship the items to you. We may refuse or cancel an order, for example if an item is out of stock, if we suspect fraud, or if there is a pricing error. If we cancel an order you have paid for, we will refund you in full.

6. Shipping and Delivery

We ship within Canada and to the United States. Free shipping is available on qualifying orders over $100 CAD, as shown at checkout. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when the order is delivered to the address you gave us. Customers outside Canada are responsible for any customs duties, import taxes or brokerage fees. 7. Returns and Refunds

Returns, exchanges and refunds are handled under our Payment & Refund Policy, which forms part of these Terms. For hygiene and safety reasons, some items, such as opened CPR masks, single-use first aid products and deployed tourniquets, may not be returnable unless they arrived damaged or defective.

8. Selling Equipment Through EMS Shop

If you sell or consign used training equipment through our Sell Your Equipment program, you confirm that you own the items and have the right to sell them, and that your description of their condition is accurate. Additional terms for sellers will be provided when you submit equipment.

9. Intellectual Property

All content on the Site, including text, images, logos, graphics and layout, belongs to EMS Shop or its licensors and is protected by copyright and trademark laws. You may not copy, reproduce or use it for commercial purposes without our written permission. Product and brand names of manufacturers belong to their respective owners.

10. Acceptable Use

You agree not to use the Site to break any law, submit false information, interfere with the Site’s security or operation, or collect other users’ information.

11. Product Warranties

New products may come with a manufacturer’s warranty, as described on the product page or packaging. Except where the law says otherwise, we do not provide any additional warranties. Nothing in these Terms limits any rights you have under applicable consumer protection laws, including the Ontario Consumer Protection Act, 2002.

12. Limitation of Liability

To the extent permitted by law, EMS Shop is not liable for any indirect, incidental or consequential damages arising from your use of the Site or our products, including damages caused by improper use, use without proper training, or use of training equipment in a real emergency. Our total liability for any claim relating to a product is limited to the amount you paid for that product. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

13. Privacy

We collect and use your personal information as described in our Privacy & Cookie Policy. We will only send you marketing emails if you have agreed to receive them, and you can unsubscribe at any time.

14. Third-Party Links

The Site may link to third-party websites, such as training providers or payment services. We are not responsible for their content or practices.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any disputes will be handled by the courts of Ontario, unless consumer protection laws where you live say otherwise.

16. Changes to These Terms

We may update these Terms from time to time. Changes take effect when they are posted on this page, and the “Last updated” date will change. Orders placed before an update are governed by the Terms in effect at the time of the order.
